Massachusetts Rape Law: Charges & Penalties

Massachusetts rape is defined under M.G.L. c. 265, Section 22. To secure a conviction, the prosecution must prove three elements beyond a reasonable doubt: (1) sexual intercourse or unnatural sexual intercourse, which requires penetration; (2) that the defendant compelled submission by force and against the victim’s will, or by threat of bodily injury; and (3) that the act was without the victim’s consent. The beyond a reasonable doubt standard is the highest burden in the legal system, and a skilled defense may challenge any one of those elements.

Sentencing & Aggravated Charges

A first-offense rape conviction carries up to 20 years in state prison. When the offense is committed while armed with a firearm, a mandatory minimum of 10 years applies. A second or subsequent conviction can result in a life sentence. Aggravated rape arises when serious bodily injury is inflicted, the rape is committed by joint venture, or other felonies are committed against the victim during the same episode; it carries even harsher exposure.

Assault with intent to commit rape is a separate charge that doesn’t require the rape itself to have occurred. It still carries significant prison exposure and can be charged even when the underlying act didn’t proceed to completion.

Sex Offender Registration & Other Consequences

A rape conviction requires mandatory registration with the Massachusetts Sex Offender Registry Board (SORB). Registration classification determines the scope and duration of reporting obligations and can follow a person for life. Unlike many other criminal charges, rape in Massachusetts can’t be continued without a finding (CWOF), meaning this common alternative disposition isn’t available to defendants.

Under Massachusetts case law established in Commonwealth v. Lopez, a defendant generally can’t claim an honest and reasonable belief in consent as a defense. The Massachusetts first complaint doctrine also governs how prior disclosures by the alleged victim are introduced at trial, which can be a significant area of defense strategy.

The damage a rape charge can cause begins before any verdict. Employers may learn of a pending case and move to suspend or terminate someone who hasn’t been convicted. Professional licensing boards in Massachusetts may initiate proceedings based on an arrest or indictment alone. Academic institutions, including Boston-area colleges and universities, frequently conduct parallel Title IX proceedings alongside the criminal case, and the outcomes in those forums are independent of what happens in court.

Sex offender registration, if required after conviction, creates long-term barriers to housing, employment, and educational opportunity that persist well after any sentence is served.
