Massachusetts law defines several distinct homicide offenses under M.G.L. c. 265. The specific charge depends on the evidence of intent, planning, and the circumstances of the death. The difference between charges can mean the difference between parole eligibility and life without it.
- First-Degree Murder: Charged on three theories: deliberately premeditated malice aforethought, extreme atrocity or cruelty, or felony murder committed during a crime punishable by life imprisonment. A conviction carries mandatory life without parole. Massachusetts has no death penalty. A first-degree conviction also triggers an automatic appeal to the Supreme Judicial Court.
- Second-Degree Murder: Requires malice aforethought but not premeditation. A conviction carries a life sentence with parole eligibility after a minimum of 15 years.
- Felony Murder: Can be charged as first- or second-degree depending on the underlying felony. It doesn’t require proof that the defendant intended to kill, only that a death occurred during the commission of a qualifying crime.
- Voluntary Manslaughter: A killing in the heat of passion following adequate provocation, without premeditation. Punishable by up to 20 years in state prison.
- Involuntary Manslaughter: A killing caused by reckless conduct without intent to kill. Also punishable by up to 20 years.
- Motor Vehicle Homicide: A separate charge for a death caused by negligent or reckless vehicle operation, including OUI-related fatalities.
