2024 – 2021 Highlights

Wrentham District Court: No complaint to issue for charge of leaving the scene of property damage after clerk magistrate’s hearing. (April 2024).

Boston Municipal Court – Roxbury: Motion to suppress firearm and ammunition stemming from a city traffic stop allowed after evidentiary hearing where two police officers testified. (April 2024).

Essex Superior Court: Large amount of cocaine and US currency suppressed after court allows Defendant’s motion alleging unlawful police conduct. (April 2024).

Suffolk Superior Court: Indictment for carrying a dangerous weapon (five year felony) dismissed after motion to dismiss heard and argued. (March 2024).

Quincy District Court: No complaint to issue for charges of identity theft and threats after clerk magistrate’s hearing. (March 2024).

Essex Superior Court: Indictments for assault with a dangerous weapon and carrying a firearm nolle prosed after demand for trial aggressively pursued. Dangerousness hold lifted sixty days early. Low cash bail set on remaining charge. Bail posted. (March 2024).

Chelsea District Court: Charge of domestic assault and battery dismissed on trial date. Client discharged from court. (March 2024).

Boston Municipal Court – Dorchester Division: Client receives pre-trial diversion for assault and battery on a police officer after mitigating documents submitted. (March 2024).

Worcester Juvenile Court: No complaint to issue after clerk magistrate’s hearing for client charged with four counts of assault and battery including two counts on a police officer. (February 2024).

Suffolk Superior Court: After motion to suppress and discovery motion for exculpatory evidence filed, indictment for third offense firearm (seven-ten year minimum mandatory felony) reduced to first offense; indictment for carrying a loaded firearm; armed career criminal; and possession of a firearm in commission of a felony dismissed. Client receives concurrent house time with sentence already served. (February 2024).

Essex Superior Court: Client indicted as armed career criminal and for firearm and drug charges. After motion to suppress on equal protection grounds argued, reasonable inference that police discriminated against client based on his race found by court. (February 2024).

Plymouth District Court: Felony OUI, third offense, dismissed after lengthy litigation. Client discharged from court. (January 2024).

Malden District Court: Motion to seal dismissal of domestic assault and battery charge allowed over the objection of the Commonwealth. Record sealed.  (August 2023).

Waltham District Court: Assault with a dangerous weapon (firearm) dismissed after motion to dismiss allowed. Client discharged from court. (August 2023).

Lowell District Court: Charges of assault and battery with a firearm causing serious bodily injury, unlawfully carrying a firearm, unlawfully carrying a loaded firearm and possession of ammunition dismissed on the day of trial. Client discharged from court. (July 2023).

Suffolk Superior Court: Client indicted for third offense unlawful firearm; Commonwealth’s motion to hold client dangerous and without bail denied after full hearing. Bail set. (July 2023).

Quincy District Court: Ten charges, including three felonies, dismissed after motion to dismiss allowed. Client discharged from court. (June 2023).

Plymouth, MA: Clients receive monetary settlement for injuries they suffered after an altercation at a local establishment and subsequent false criminal charges that were later dismissed. (March 2023).

Suffolk Superior Court: Thirteen count indictment, including eight life felony counts, nolle prossed after lengthy litigation and discovery of exculpatory information. Client discharged from court. (March 2022).

Suffolk Superior Court: Client found not guilty after jury trial of aggravated assault and battery with a dangerous weapon causing serious bodily injury; assault and battery on a person over 60; assault and battery with a dangerous weapon on a person over 60; and armed burglary, a life felony. Cambridge District Court: Malicious destruction of property complaint dismissed prior to arraignment after clerk magistrate’s hearing. (August 2021).

Boston Municipal Court – South Boston Division: Two pounds of methamphetamine seized – after bail argument, bail set at $10,000 after Commonwealth’s request of $150,000 bail denied. (August 2021).

Boston Municipal Court – Dorchester Division: Two counts of felony strangulation dismissed after motion to dismiss allowed. (August 2021).

Suffolk Superior Court: Aggravated rape and assault to rape indictments dismissed after motion to dismiss allowed. (July 2021).

Norfolk Superior Court: Indictment for accessory after the fact to armed robbery nolle prossed prior to arraignment after motion to dismiss filed in corresponding case. Client discharged. (July 2021).

Malden District Court: Client granted summary judgment in defamation lawsuit. (June 2021).

2020 – 2018 Highlights

Supreme Judicial Court: Emergency 211/3 petition allowed by Single Justice – client released from custody. (April 2020).

Lynn District Court: Client found not guilty after jury trial of assault and battery with a dangerous weapon; not guilty of assault and battery on a police officer; not guilty of OUI liquor; and not guilty of negligent operation; in addition, five motor vehicle civil violations dismissed. Client released from custody and discharged from court. (February 2020).

Wrentham District Court: Client found not guilty after jury trial of strangulation, not guilty of kidnapping, not guilty of threats and not guilty of domestic assault and battery.

Wrentham District Court: Client found not guilty  after jury trial of OUI drugs and not guilty of negligent operation.

Wrentham District Court: Client found not guilty after jury trial of OUI liquor.

Quincy District Court: Client found not guilty after bench trial of domestic assault and battery.

Quincy District Court: Client found not guilty after jury trial of assault and battery.

Boston Municipal Court – Central Division: Client found not guilty after bench trial of assault and battery, by reason of mental illness.

Suffolk Superior Court: Trafficking +100 grams of Class B reduced to possession with intent at suppression hearing.

Newton District Court: Three counts of domestic assault and battery nolle prossed after motion to dismiss filed. Case dismissed.

Cambridge District Court: Motion to suppress evidence from search allowed; motion to suppress statements allowed – client given pre-trial diversion.

Framingham District Court: Indecent assault and battery felony dismissed after Commonwealth’s motion to admit excited utterance of child denied. Case dismissed.

Boston Municipal Court – East Boston Division: Application for criminal complaint denied for possession with intent to distribute seventeen pounds of marijuana.

Cambridge District Court: Plaintiff’s motion to extend restraining order denied after full hearing – order terminated.

Plymouth District Court: OUI third offense dismissed after motion to dismiss allowed. Case dismissed.

Woburn District Court: Domestic assault and battery and violation of wiretapping statute nolle prossed prior to arraignment.

Somerville District Court: Petition to seal record allowed.

Brookline District Court: Harassment prevention order terminated.

DCF – Middlesex County: After Fair Hearing, reversal of three findings of neglect.

Taunton District Court: Client given pre-trial diversion for abuse prevention order violation.

Falmouth District Court: Felony larceny dismissed day of trial. Case dismissed.
