2024 – 2021 Highlights

Woburn District Court: Probation department’s request to hold client in custody pending final surrender hearing, denied. (February 2024).

Worcester Juvenile Court: No complaint to issue after clerk magistrate’s hearing for client charged with four counts of assault and battery including two counts on a police officer. (February 2024).

Suffolk Superior Court: After motion to suppress and discovery motion for exculpatory evidence filed, indictment for third offense firearm (seven-ten year minimum mandatory felony) reduced to first offense; indictment for carrying a loaded firearm; armed career criminal; and possession of a firearm in commission of a felony dismissed. Client receives concurrent house time with sentence already served. (February 2024).

Essex Superior Court: Client indicted as armed career criminal and for firearm and drug charges. After motion to suppress on equal protection grounds argued, reasonable inference that police discriminated against client based on his race found by court. (February 2024).

Plymouth District Court: Felony OUI, third offense, dismissed after lengthy litigation. Client discharged from court. (January 2024).

Woburn District Court: No complaint to issue after clerk magistrate’s hearing for charge of assault and battery. (January 2024).

Boston Municipal Court – Dorchester Division: Charges of assault and battery with a dangerous weapon (2X); and assault with a dangerous weapon (2X) dismissed after exculpatory video produced in investigation. Client discharged from court. (December 2023).

Boston Municipal Court – Roxbury Division: Motion to suppress a firearm and ammunition seized from client by police after a warrantless stop at a city park, Allowed. (December 2023).

Waltham District Court: Warrant cleared; criminal charge and civil infraction dismissed prior to arraignment. Client discharged from court. (December 2023).

Wrentham District Court: Petition to seal assault and battery charge allowed. Record sealed. (December 2023).

Woburn District Court: Harassment prevention order extension denied after full hearing. Order to terminate. (November 2023).

Middlesex Superior Court: Armed assault to murder charge dismissed; trafficking cocaine charge reduced to possession with intent. Client receives straight probation after substantial mitigation packet submitted. (November 2023).

Woburn District Court: After trial client found not guilty of violating abuse prevention order. Client discharged from court. (October 2023).

Lowell District Court: Charges of carrying a firearm without a license, carrying a loaded firearm without a license and carrying a firearm while intoxicated dismissed after motion to dismiss allowed. Client discharged from court. (October 2023).

Salem District Court: No complaint to issue after clerk magistrate’s hearing. (September 2023); Additionally, charges of reckless operation; failure to stop for police dismissed after motion to dismiss allowed. (September 2023).

Suffolk Superior Court: No violation found at final probation surrender after full hearing. (September 2023).

Natick District Court: Charges of assault with a dangerous weapon and domestic assault and battery dismissed. (September 2023).

Plymouth Superior Court (Brockton): Fifth Amendment for witness found and approved by judge after hearing.  (August 2023).

Malden District Court: Motion to seal dismissal of domestic assault and battery charge allowed over the objection of the Commonwealth. Record sealed.  (August 2023).

Waltham District Court: Assault with a dangerous weapon (firearm) dismissed after motion to dismiss allowed. Client discharged from court. (August 2023).

Lowell District Court: Charges of assault and battery with a firearm causing serious bodily injury, unlawfully carrying a firearm, unlawfully carrying a loaded firearm and possession of ammunition dismissed on the day of trial. Client discharged from court. (July 2023).

Suffolk Superior Court: Client indicted for third offense unlawful firearm; Commonwealth’s motion to hold client dangerous and without bail denied after full hearing. Bail set. (July 2023).

Quincy District Court: Ten charges, including three felonies, dismissed after motion to dismiss allowed. Client discharged from court. (June 2023).

Lawrence District Court: Three probation warrants from the year 2000 cleared and probation terminated with restitution forgiven in full. Client discharged from court. (May 2023)

Boston Municipal Court – Central Division: Pre-arraignment diversion for charges of assault and disorderly conduct after mitigation packet presented. (May 2023).

Norfolk Superior Court: Motion to clear warrant and terminate probation allowed. Client discharged from court. (April 2023).

Suffolk Superior Court: Several indictments charging life felonies and various other charges nolle prossed on the eve of trial after lengthy litigation. Client discharged from court. (March 2023).

Plymouth, MA: Clients receive monetary settlement for injuries they suffered after an altercation at a local establishment and subsequent false criminal charges that were later dismissed. (March 2023).

Essex Superior Court: After substantial mitigation packet filed, client receives straight probation over Commonwealth’s request for multiple year state prison sentence. (February 2023).

Suffolk Superior Court: Client found not guilty after jury trial of assault and battery with a firearm; carrying a firearm; carrying a loaded firearm; and possession of ammunition. Client discharged from court. (February 2023).

Dedham District Court: Client found not guilty after jury trial of vehicular homicide by negligent operation. Trial involved multiple expert witnesses and sophisticated medical and accident reconstruction evidence. Client discharged from court. (January 2023).

Woburn District Court: Trafficking class B over 200 grams (ten pounds of methamphetamine) and accompanying charges dismissed after motion for failure to provide speedy trial granted. Client discharged from court. (January 2023).

Salem District Court: Three counts of domestic assault and battery dismissed. Client discharged from court. (December 2022).

Boston Municipal Court – Dorchester Division: Carrying a firearm and assault and battery with a firearm dismissed after lengthy investigation and litigation. Client discharged from court. (November 2022).

Waltham District Court: Criminal charge for violation of abuse prevention order dismissed after exculpatory evidence presented to Commonwealth . Client discharged from court. (October 2022).

Middlesex Superior Court: Commonwealth’s motion to hold client without bail under dangerousness statute denied, client released from custody. (October 2022).

Stoughton District Court: Pre-trial probation granted for two counts of assault and battery. (September 2022).

Plymouth District Court: Felony charge of assault and battery with a dangerous weapon dismissed after exculpatory information learned through defense investigation. Client discharged from court. (May 2022).

Malden District Court: Violation of abuse prevention order dismissed after motion to dismiss allowed. Client discharged from court. (April 2022).

Suffolk Superior Court: Thirteen count indictment, including eight life felony counts, nolle prossed after lengthy litigation and discovery of exculpatory information. Client discharged from court. (March 2022).

Suffolk Superior Court: Client found not guilty after jury trial of aggravated assault and battery with a dangerous weapon causing serious bodily injury; assault and battery on a person over 60; assault and battery with a dangerous weapon on a person over 60; and armed burglary, a life felony. Brockton Superior Court: Indictment for trafficking firearms dismissed after motion to dismiss allowed. (November 2021).

Suffolk Superior Court: Indictments for armed home invasion, assault and battery with a dangerous weapon and assault with a dangerous weapon nolle prossed after lengthy litigation. Case dismissed. (October 2021).

Wrentham District Court: Felony possession of RMV document complaint dismissed prior to arraignment after mitigation packet and motion to dismiss provided to Commonwealth. (August 2021).

Cambridge District Court: Malicious destruction of property complaint dismissed prior to arraignment after clerk magistrate’s hearing. (August 2021).

Boston Municipal Court – South Boston Division: Two pounds of methamphetamine seized – after bail argument, bail set at $10,000 after Commonwealth’s request of $150,000 bail denied. (August 2021).

Boston Municipal Court – Dorchester Division: Two counts of felony strangulation dismissed after motion to dismiss allowed. (August 2021).

Suffolk Superior Court: Aggravated rape and assault to rape indictments dismissed after motion to dismiss allowed. (July 2021).

Norfolk Superior Court: Indictment for accessory after the fact to armed robbery nolle prossed prior to arraignment after motion to dismiss filed in corresponding case. Client discharged. (July 2021).

Malden District Court: Client granted summary judgment in defamation lawsuit. (June 2021).

Plymouth Superior Court: Motion to vacate conviction on double jeopardy grounds allowed. (June 2021).

Newton District Court: Pre-trial diversion on charge of leaving the scene of property damage. (May 2021).

Lowell District Court: Client given diversion prior to arraignment on charges of assault and battery and witness intimidation. (January 2021).

Quincy District Court: 25(b)(2) motion for new trial allowed. Conviction overturned. Charge of indecent assault and battery nolle prossed by Commonwealth. (January 2021).

2020 – 2018 Highlights

Supreme Judicial Court: Emergency 211/3 petition allowed by Single Justice – client released from custody. (April 2020).

Lynn District Court: Client found not guilty after jury trial of assault and battery with a dangerous weapon; not guilty of assault and battery on a police officer; not guilty of OUI liquor; and not guilty of negligent operation; in addition, five motor vehicle civil violations dismissed. Client released from custody and discharged from court. (February 2020).

Wrentham District Court: Client found not guilty after jury trial of strangulation, not guilty of kidnapping, not guilty of threats and not guilty of domestic assault and battery.

Wrentham District Court: Client found not guilty  after jury trial of OUI drugs and not guilty of negligent operation.

Wrentham District Court: Client found not guilty after jury trial of OUI liquor.

Quincy District Court: Client found not guilty after bench trial of domestic assault and battery.

Quincy District Court: Client found not guilty after jury trial of assault and battery.

Boston Municipal Court – Central Division: Client found not guilty after bench trial of assault and battery, by reason of mental illness.

Boston Municipal Court – Central Division: Client found not guilty after jury trial of OUI liquor.

Suffolk Superior Court: Trafficking +100 grams of Class B reduced to possession with intent at suppression hearing.

Newton District Court: Three counts of domestic assault and battery nolle prossed after motion to dismiss filed. Case dismissed.

Cambridge District Court: Motion to suppress evidence from search allowed; motion to suppress statements allowed – client given pre-trial diversion.

Framingham District Court: Indecent assault and battery felony dismissed after Commonwealth’s motion to admit excited utterance of child denied. Case dismissed.

Boston Municipal Court – East Boston Division: Application for criminal complaint denied for possession with intent to distribute seventeen pounds of marijuana.

Cambridge District Court: Plaintiff’s motion to extend restraining order denied after full hearing – order terminated.

Plymouth District Court: OUI third offense dismissed after motion to dismiss allowed. Case dismissed.

Woburn District Court: Domestic assault and battery and violation of wiretapping statute nolle prossed prior to arraignment.

Somerville District Court: Petition to seal record allowed.

Brookline District Court: Harassment prevention order terminated.

DCF – Middlesex County: After Fair Hearing, reversal of three findings of neglect.

Taunton District Court: Client given pre-trial diversion for abuse prevention order violation.

Falmouth District Court: Felony larceny dismissed day of trial. Case dismissed.
